In this Service Agreement ("Agreement"), "you" and "your" refer to each customer ("Customer") and its agents, including each person listed in your account information as being associated with your account, and "we", "us" and "our" refer collectively to JoomContact for Joomla and its wholly-owned subsidiaries (JoomContact.com). This Agreement explains our obligations to you, and your obligations to us in relation to the JoomContact.com service(s) or software(s) you purchase. By purchasing or otherwise applying for JoomContact.com product(s), you agree to establish an account with us for such services.
2. FEES, PAYMENT AND TERM OF SERVICE.
As consideration for the services/products you purchased, you agree to pay our company the applicable fees set forth on our Web site at the time of your selection, or, if applicable, upon receipt of your invoice from us. All fees are due immediately and are non-refundable, except as otherwise expressly noted.
Unless otherwise specified herein or on our Web site, with the purchase of any service/product you will get six (6) months of FREE updates. There are also two other license periods: One Year and Unlimited (life time). Any renewal of your services with us is subject to our current terms and conditions, including, but not limited to, successful completion of any applicable authentication procedure, and payment of all applicable fees at the time of renewal.
All licenses are subject to the Fair use policy described in this document.
The Unlimited license has free support and free downloads for as long as the product is in production. If for some reason we decide to discontinue the software we will still provide support for another 5 years;
All payments of fees for our services/products shall be made in U.S. dollars, unless state otherwise. Set up fees, if any, will become payable on the applicable effective date for the applicable services. All sums due and payable that remain unpaid after any applicable cure period herein will accrue interest as a late charge of 1.5% per month or the maximum amount allowed by law, whichever is less.
You are allowed to use the extension on more than one domain, however we provide support only for the domain you've registered with us, for the length of your subscription. We currently offer only one subscription plan. However we will be offering other subscription plans in the future.
Both our support system and our forum will check that you have an active license before it allows you to submit a support ticket or post a forum question/read forum answers.
3. ACCURATE INFORMATION
You agree to: (1) provide certain true, current, complete and accurate information about you as required by the application/registration process; and (2) maintain and update according to our modification procedures the information you provided to us when purchasing our services/products as needed to keep it current, complete and accurate. We rely on this information to send you important information and notices regarding your account and our services.
4. SOFTWARE LICENSE
All Joomla Extensions produced by JoomContact are released under the GNU General Public License (GNU GPL), version 2 (http://www.gnu.org/licenses/gpl-2.0.html).
5. SUPPORT SERVICES
Some software and services purchased from us may include limited free support (technical support, re-downloads, and free updates may be limited to 6 months from date of original qualifying purchase). Unless stated otherwise, the free support is only available through our website/forum. If you require more advanced technical support or require telephone assistance, additional consulting services or a support plan may be required. We reserve the right to change our support policy at anytime. To contact our support dept. for assistance, click on "Contact Us" and follow the links to "Technical Support".
6. RETURN POLICY
Software (including but not limited to all html, php, js, css, graphic/image, and text files) that is not specifically referred to as "trial software", or that includes the "source code", cannot be returned for a refund. Should you experience a problem with any purchased software, JoomContact offers support services to assist with any technical issues. There are no refunds on installation services or any software that has been installed, downloaded, or emailed to you.
You must make every attempt to safeguard your data and other files during installation, when upgrading, or when installing an update. We do not assume responsibility for loss of data or any other losses that result from installation, upgrading, or updating of the software. Hard disks (including but not limited to all data or files related to Joomla) should be backed up on a regular basis and should always be backed up before you begin any installation tasks.
8. OPTIONAL INSTALLATION SERVICE
If you have purchased the optional installation service, we will install the software onto your web server. Our technicians will then test the online front-end and back-end (administration). Installation includes basic configuration only, unless stated in writing prior to installation. We will not setup your items, categories or any other elements. After we determine that the installation was successful, technical support is provided at the current technical support department hourly rate. By accepting our services, you acknowledge that we are not responsible for any web hosting monthly fees, setup fees, or any other fees associated with the use or installation of our software or scripts. While we will make every attempt to safeguard data during installation or service, we do not assume responsibility for loss of data. Hard disks and all data on your server should be backed up on a regular basis and should always be backed up before we are called for service or installation. We are not responsible for any loss of data.
9. MODIFICATION OF EXTENSIONS.
You are authorized to make any modification(s) to JoomContact extension PHP code. However, if you change any PHP code and it breaks functionality, support may not be available to you
10. GENERAL DISCLAIMER
JoomContact neither assumes nor accepts any liability for any loss, damage, theft, misuse, malfunction, etc. of your hardware or data or anything else that you may own regardless of the cause or reason for any such misfortune. JoomContact, it’s officers, and employees will not be liable for lost profits, loss of business or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party . These policies, terms, and conditions may be subject to change without notice.
11. FAIR USE POLICY
JoomContact.com strive to provide low cost, high quality services surrounding their software. In order to keep the costs low, without placing artificial restrictions, we have a fair use policy in place. In no event shall we provide support to anyone who is seeking our support for more than three domains per month. This restriction is in place to deter edge cases, like a hosting provider buying a single subscription, installing the software on all of his clients' sites and then overflowing our support services with its client's requests. If such behaviour is detected, we regret to inform you that we will immediately terminate the user account without a refund.
Moreover, JoomContact.com reserves the right to terminate any account which is suspected in being implicated in unlawful or abusive activity, including –but not limited to– unsolicited mass distribution of our for-a-fee software. Account termination is in the sole discretion of JoomContact.com and we reserve the right to not provide any prior warning or further information.
